Ademola-Salami, presiding over Court 15, struck out the case on Thursday, citing a defective affidavit and insufficient evidence. The judge also awarded N500,000 in costs against Adams in favour of Igboho.Adams had accused Igboho of unlawfully recording and publishing a private phone conversation, allegedly violating his right to privacy under Section 37 of the 1999 Constitution. However, Igboho’s counsel, Kayode Sanusi, argued that the suit was procedurally flawed, noting that Adams failed to personally depose to the affidavit, a legal requirement that was not properly addressed.The court upheld the objection, ruling the affidavit inadmissible and stating Adams failed to substantiate his claims.
